PROVIDENCE, R.I. (AP) — A federal judge has dismissed a lawsuit over Rhode Island’s new truck tolls.

A U.S. District Court judge said Tuesday that the court lacks jurisdiction and the case should be brought in the state court system.

Rhode Island began tolling trucks in June as part of an infrastructure plan to repair bridges and roads.

The American Trucking Associations, a national industry group, sued, arguing that the tolls violate the U.S. Constitution’s Commerce Clause and pose a discriminatory and disproportionate burden on out-of-state operators and truckers.

Cumberland Farms, New England Motor Freight and M&M Transport Services are also plaintiffs in the lawsuit.

The state argued that the District Court cannot restrain the collection of state taxes, such as tolls, and state matters should be adjudicated in state court.
